REFUND, RETURN, AND WITHDRAWAL POLICY

1. Purpose

This Policy regulates the conditions applicable to returns, refunds, and the exercise of the right of withdrawal for products purchased through the E-NextRider Sport Pro Gear S.L. online store.

This policy shall apply without prejudice to the rights granted to the consumer under current legislation.

Issues regarding lack of conformity and warranties are specifically regulated in our Warranty Policy.

2. Right of withdrawal

When the buyer has the legal status of a consumer and user, they will have a period of 14 calendar days to exercise their right of withdrawal, without the need to justify their decision, except in cases where legislation establishes an exception.

The period shall begin to count from the day on which the consumer, or a third party indicated by them other than the carrier, acquires physical possession of the product.

When the order consists of several products delivered separately, the period shall begin to count from the receipt of the last product.

3. How to exercise the right of withdrawal

To exercise the right of withdrawal, the customer must communicate their decision to E-NextRider Sport Pro Gear S.L. by means of an unequivocal statement.

It is not mandatory to use this template as long as the communication clearly identifies the decision to withdraw.

4. Deadline for returning the product

Once the withdrawal has been communicated, the customer must return or deliver the products to E-NextRider Sport Pro Gear S.L. without undue delay and, in any case, within a maximum period of 14 calendar days from the communication of their decision to withdraw.

The deadline shall be considered met if the customer makes the return before said period has expired.

5. Return costs

In the event of exercising the right of withdrawal, the direct costs of return shall be borne by the customer, unless E-NextRider Sport Pro Gear S.L. has agreed to assume them or if the company is legally required to assume them.

In the case of large volume products, electric vehicles, motorcycles, karts, or other products requiring special transport, the cost of return may be considerably higher than that of a conventional package.

Where legally applicable, E-NextRider will inform the customer of such costs in advance.

6. Refund

Once the right of withdrawal has been correctly exercised, E-NextRider Sport Pro Gear S.L. will refund the customer all payments received, including delivery costs corresponding to the most economical standard shipping method offered during the purchase.

Additional costs resulting from the customer's choice of a more expensive delivery method than the standard option offered do not need to be refunded.

7. Deadline for the refund

The refund will be made without undue delay and, at the latest, within 14 calendar days from the date on which E-NextRider has been informed of the decision to withdraw.

However, where legislation permits, E-NextRider may withhold the refund until it has received the products or until the customer provides proof of their return, whichever condition is met first.

8. Method of refund

The refund will be made using the same payment method used by the customer for the initial transaction, unless the customer has expressly agreed to another method.

The refund will not involve any cost for the customer, except for those costs that may legally correspond to them for the return of the product.

9. Condition of returned products

The customer may examine the product in the same way they would in a physical store to verify its nature, characteristics, and functioning.

The consumer will be responsible for the diminished value of the product when this is the result of handling other than what is necessary to establish the nature, characteristics, and functioning of the product.

Therefore, we recommend keeping during the withdrawal period:

original packaging;
accessories;
chargers;
manuals;
documentation;
protective elements;
any other component supplied with the product.

10. Products with lithium batteries

Certain products sold by E-NextRider incorporate lithium batteries.

Due to the characteristics of these batteries, their return may require special transport, packaging, and handling conditions.

The customer must contact E-NextRider before returning any product incorporating a lithium battery to receive the corresponding instructions.

A lithium battery must not be sent using a transport service that is not authorized or prepared for this type of merchandise.

11. Large volume products

For products such as:

electric unicycles (EUC);
electric scooters;
electric motorcycles;
electric motocross bikes;
karts;
electric sports vehicles;

the return may require specialized transport.

In these cases, the customer must contact E-NextRider before shipping to correctly coordinate the return.

12. Made-to-order products

E-NextRider sells certain products through a made-to-order system.

The fact that a product is purchased made-to-order does not in itself eliminate the legal right of withdrawal where applicable.

However, certain products may be legally excluded from the right of withdrawal, for example, when they have been manufactured according to consumer specifications or clearly personalized, provided that the requirements established by legislation are met.

When a product falls under a legal exception to the right of withdrawal, this circumstance will be communicated to the customer before finalizing the purchase where applicable.

13. Personalized products

Products manufactured or modified specifically according to the customer's instructions or specifications may be excluded from the right of withdrawal when current legislation so establishes.

This exclusion will not affect the legal warranty rights that apply in case of lack of conformity.

14. Incorrect or damaged products

If the customer receives a product different from the one requested or a product that presents damage attributable to transport, they must notify E-NextRider as soon as possible.

The company will handle the issue and, where appropriate, may proceed with:

replacement;
repair;
refund;
or another legally applicable solution.

These situations should not be confused with the exercise of the right of withdrawal.

15. Defective products

If the product presents a lack of conformity, the customer must use the procedure established in our Warranty Policy.

The legal warranty and the right of withdrawal are different rights and will be applied according to the circumstances of each case.

16. Purchases made by companies or professionals

The withdrawal conditions provided for consumers do not necessarily apply to buyers acting as companies, self-employed individuals, or professionals.

In these cases, the corresponding contractual conditions and the regulations applicable to the business relationship between the parties will apply.

17. Refunds for orders canceled before shipping

When an order can be canceled before it is dispatched and a refund is appropriate, it will be made using the same payment method used to make the purchase, unless otherwise agreed.

The refund time will depend on the payment method and the procedures of the corresponding provider.

18. Payment methods and refunds

Payments made via PayPal, Klarna, Shop Pay, Apple Pay, Google Pay, Visa, Mastercard, American Express, UnionPay, or other methods available in the store may be refunded via the same method or system used to perform the transaction, when technically possible.

The times required for the amount to reappear in the customer's account may depend on the payment service provider or the corresponding financial institution.

19. Exceptions to the right of withdrawal

The right of withdrawal will not be applicable in those cases expressly established by current legislation.

Among other legally provided cases, there may be exceptions for certain products:

personalized;
manufactured according to consumer specifications;
sealed products that are not suitable for return for health protection or hygiene reasons when they have been unsealed;
or other products contemplated by regulations.

When an exception is applicable, the customer will be informed before the purchase where legally required.

20. Consumer rights

Nothing stated in this Refund, Return, and Withdrawal Policy shall be interpreted as a waiver, limitation, or exclusion of the rights legally recognized to consumers.

In case of contradiction between this policy and an applicable mandatory rule, the current legislation shall prevail.
